La Justicia Terapéutica: Un enfoque de nuevo rigor científico para la reintegración del delincuente

La Justicia Terapéutica, TJ por sus siglas en inglés, es un enfoque reciente, tributario de la criminología crítica, pero que se concentra en la utilidad de nociones terapéuticas de la psicología en el ámbito de la justicia penal para combinar los aspectos legales y de prevención en el tratamiento de delincuentes. Se discuten los resultados de investigaciones y evaluaciones que han demostrado los beneficios de la TJ en términos de reducción de la reincidencia delictiva, mejora en la salud mental, el bienestar de los participantes, y ahorro de costos para el sistema de justicia penal. Sin embargo, desde la Teoría General del Derecho hasta epistemólogos de referencia como K. Popper, descartan el uso a priori de la psicología, como de toda formulación idealista, por su excesivo subjetivismo y acientificismo. Este artículo pone en relieve que los resultados de la TJ, reposicionan la importancia de la filosofía en el debate científco, así como apsecto del pensamiento psicológico, mántico y estético en el debate criminológico, por cuanto sus resultados, si bien sus procedimientos son ubicuos, son suficientemente estables para utilidad empírica y pensamiento riguroso. Se recomienda la profundización analítica de los recursos e instrumentos de la TJ para el debate de la noción de ciencia y el fortalecimiento del episteme criminológico.
