The Temporal Dimension of Law: Hyperbolicity and Normative Indeterminacy in Colombian Constitutionalism

The configuration of time as a fundamental legal element has become a subject of increasing debate in contemporary constitutionalism. In the Colombian case, the normative, jurisprudential, and doctrinal review reveals that fundamental rights are shaped by temporal dynamics that condition their effectiveness. This article analyzes the role of temporality in law through two analytical models: hyperbolicity and the indeterminate equation. Hyperbolicity illustrates the unequal propagation of normative effects and its impact on the effectiveness of rights, while the indeterminate equation explains the uncertainty generated by undefined or variable legal deadlines. The findings highlight deficits of temporal effectiveness and certainty, which hinder the full guarantee of rights in Colombia. Finally, the article proposes the development of a protective microsystem of time, incorporating binding standards of temporal reasonableness, normative propagation indicators, and the explicit recognition of time as a fundamental right.
